Cancellation Policy

Cancellations must be submitted within 1 hour of placing the order. After this period, orders are considered final and may not be canceled or modified.

 

Return Policy

We have a 30-day return policy, which means you have 30 days after receiving your item to request a return.

To be eligible for a return, you must receive written approval from the Company through a Return Authorization form from Customer Service. The item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

Return shipping costs will be deducted from your refund along with a 25% restocking fee. Return shipping costs can vary depending on the location of the return.

Damages and issues
Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

Exceptions / non-returnable items
Certain types of items cannot be returned, like Made to Order (MTO) products. Please get in touch if you have questions or concerns about your specific item.

Exchanges
The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.

Refunds
We will notify you once we’ve received and inspected your return and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 10 business days. Please remember it can take some time for your bank or credit card company to process and post the refund too.

OUR COMMITMENT TO YOU

This Maitland-Smith Customer Limited Warranty (“Warranty”) applies to products sold under the Maitland-Smith brand. This Warranty is extended solely to the original retail purchaser and is not transferable.

Maitland-Smith warrants the products and components described below against defects in materials and workmanship when used under “ordinary residential use” conditions. Unless otherwise stated, the applicable warranty period begins on the factory ship date.

For purposes of this Warranty, “ordinary residential use” means use within a single-family residence, with proper care and maintenance, and without misuse, abuse, accident, alteration, negligence, or commercial use. Maintenance and cleaning must be performed in accordance with Maitland-Smith’s published care instructions. Maintenance, repairs, modifications, or cleaning performed outside of these instructions may void this Warranty.

Upon inspection and confirmation of a covered defect by an authorized Maitland-Smith representative, Maitland-Smith will, at its sole discretion, repair, replace, or provide a comparable substitute product for the defective product or component, subject to the limitations and exclusions stated in this Warranty.

For purposes of this Warranty, a 'defect in materials or workmanship' means a manufacturing defect that impairs the functionality or structural integrity of the product and is not attributable to normal wear and tear, misuse, abuse, accident, environmental conditions, or natural material characteristics.

Wood Products

Maitland-Smith warrants wood furniture and wood components against defects in materials and workmanship, subject to the limits set forth below, for one (1) year when used under ordinary residential conditions.

Stone, Glass, Mirror and Other Non-Wood Surfaces

Maitland-Smith warrants stone, glass, mirror, and other non-wood surfaces for 180 days when used under ordinary residential conditions.

Natural stone may contain natural characteristics such as pits, fissures, mineral deposits, veining, color variations. Depending upon the intended design and appearance, pits, fissures, and voids may or may not be filled with resin. Natural characteristics are not considered defects unless determined by Maitland-Smith to be excessive and structurally detrimental.

Mirror surfaces may be intentionally antiqued, distressed, or leafed. Small marks, variations, or areas of character associated with these techniques are not considered defects. Hand-cut or hand-beveled mirror glass may display slight waves, movement, or variations along the beveled edge. These characteristics are inherent in the handcrafted process and are not considered defects.

Finishes

Maitland-Smith warrants standard finishes applied to wood surfaces for one (1) year when used under ordinary residential conditions.

Natural wood, veneers, and other organic materials display variations in color, grain, figure, pattern, and texture. These variations contribute to the individual character of each piece and are not considered defects. This Warranty does not cover naturally occurring variations or changes associated with wood, veneer, grain patterns, or finish coloration.

Hardware

Maitland-Smith warrants casegoods hardware, including pulls, handles, hinges, and locks, for one (1) year when used under ordinary residential conditions.

When available, matching replacement hardware will be provided for an approved Warranty claim. When matching hardware is no longer
available, Maitland-Smith may provide a reasonably similar replacement set for the affected furniture unit.

Maitland-Smith warrants functional drawer glides for one (1) year when used under ordinary residential conditions.

Upholstered Products

Maitland-Smith warrants standard, unaltered indoor upholstery against defects in materials and workmanship, subject to the limitations set forth below, for one (1) year when used under ordinary residential conditions. Products that have been altered, recovered, or reupholstered are not covered.

Maitland-Smith warrants cushion cores against the loss of resiliency for one (1) year when used under ordinary residential conditions.  Loss of resiliency should not be confused with the normal softening or flattening of polyester fiber, feather-and-down blends, foam, or other cushioning materials that occur through
ordinary use and aging. Normal softening, settling, compression, and flattening are not considered defects in materials or workmanship and are not covered by this Warranty. 

Maitland-Smith warrants chair, swivel, rocker, glider, reclining, and motion-seating mechanisms, as well as functional casters, for one (1) year when used under ordinary residential conditions.

Decorative brass, nickel, or other ornamental casters are decorative in nature and are not intended to function as weight-bearing mobility devices. Furniture fitted with decorative casters may be moved only with care. Damage caused by using decorative casters as weight-bearing movement devices is not covered by this Warranty.

Fabrics and Leathers

Maitland-Smith warrants fabrics and leathers included in its standard product offerings against the following defects for one (1) year when used under ordinary residential conditions:

• Sewn-seam failure
• Excessive fading, excluding fading caused by direct or prolonged sunlight exposure
• Excessive pilling, unless pilling is an inherent characteristic of the fabric
• Tearing or ripping
• Yarn failure

The following natural characteristics and conditions are not considered defects and are not covered by this Warranty: 

• Color, grain, or texture variations inherent in natural fibers or leather. 
• Yarn slubs, knots, irregularities, and other characteristics inherent in woven materials.
• Changes in the nap of fabrics such as velvet, including crushing, shading, and visible changes in hue
• Gradual wear or pilling caused by the friction of ordinary use.
• Stretching, wrinkling, creasing, or puddling resulting from ordinary use
• Natural leather markings, scars, wrinkles, grain variations, and color variations.
• Changes in leather color, texture, sheen, or stiffness resulting from normal use and aging. Certain leathers are more resistant than others to changes in appearance and performance. Information regarding the suitability of a particular leather for the purchaser’s intended use may be obtained from an authorized Maitland-Smith dealer.

Lighting

Maitland-Smith warrants lighting products—including table lamps, floor lamps, chandeliers, sconces, pendants, and lighting incorporated into furniture—for one (1) year when used under ordinary residential conditions.  Light bulbs and other replaceable consumable components are not covered unless otherwise required by
applicable law.

 

 GENERAL LIMITATIONS AND EXCLUSIONS

The following limitations and exclusions apply to this Warranty:

• The remedies provided under this Warranty are the sole and exclusive remedies for any loss, damage, or claim arising from a nonconforming product, defective materials or workmanship, or any other matter covered by this Warranty. Except as expressly provided in this Warranty, Maitland-Smith makes no other warranties, express or implied, statutory or otherwise. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY IMPLIED WARRANTY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, IS LIMITED IN DURATION TO THE APPLICABLE WARRANTY PERIOD SET FORTH IN THIS WARRANTY.
• Maitland-Smith shall not be liable for incidental, indirect, special, or consequential damages of any kind, including loss of use, loss of time, inconvenience, commercial loss, or damage to other property, to the fullest extent permitted by applicable law.
• This Warranty applies only to the original retail purchaser of a Maitland-Smith product purchased from an authorized Maitland-Smith dealer.
• This Warranty is not transferable.
• This Warranty does not cover normal wear and tear or damage resulting from:
• Negligence, misuse, abuse, or improper care
• Commercial, hospitality, rental, institutional, or contract use
• Use of the product for a purpose or in an environment for which it was not designed
• Improper installation, assembly, handling, storage, or transportation
• Tampering, modification, alteration, or unauthorized repair
• Accidents or acts of third parties
• Damage caused by pets
• After-market protective treatments or coatings
• Cleaning products, treatments, or techniques not approved by Maitland-Smith
• Spills, stains, moisture, or water damage
• Exposure to direct sunlight, except as otherwise specifically provided for outdoor products
• Body oils, perspiration, tanning lotions, cosmetics, medications, dyes, or other chemicals
• Chipping, denting, scratching, cracking, gouging, or other damage occurring during handling, delivery, installation, relocation, or use after the product has left Maitland-Smith’s control
• This Warranty does not cover floor samples, showroom or display samples, clearance merchandise, discontinued merchandise sold without warranty, or products designated or sold “as is.”
• This Warranty does not cover finishes on outdoor products or damage caused by acts of nature or environmental conditions, including water, freezing temperatures, fire, wind, flooding, storms, excessive heat, humidity, salt air, or other severe weather conditions.
• This Warranty does not cover finish failure or corrosion resulting from the use of outdoor products near indoor pools, saltwater pools, coastal or seaside environments, or other highly corrosive settings when reasonable and necessary care has not been performed in accordance with Maitland-Smith’s care and maintenance instructions.
• In addition to the other limitations and exclusions stated in this Warranty, coverage for outdoor products does not include:
• The use of indoor fabrics or materials on outdoor products
• Mildew, mold, or discoloration of wood or other natural materials
• Fading, oxidation, or discoloration of metal products
• Scratching, peeling, flaking, or chipping of paint or finishes
• Natural fading, weathering, patina, or aging of finishes
• Routine wear to wheels, glides, mechanisms, moving parts, fasteners, or hardware
• Customer’s Own Material (“COM”), Customer’s Own Leather (“COL”), and any other customer-supplied materials are excluded from this Warranty. Maitland-Smith is not responsible for the appearance, durability, performance, colorfastness, suitability, or failure of customer-supplied materials.
• Maitland-Smith’s obligations under this Warranty are limited to the repair or replacement of the covered product or component that Maitland-Smith determines, after inspection by an authorized Maitland-Smith representative contains a defect in materials or workmanship.
• Replacement parts or products may vary in color, grain, texture, finish, construction, or appearance from the original due to natural material variation, product aging, manufacturing changes, or product discontinuation.
• When an identical replacement product or component is unavailable, Maitland-Smith may provide a reasonably comparable substitute at its sole discretion.
• Refunds, returns, credits, compensation for loss of use, and reimbursement of incidental expenses are not available under this Warranty unless otherwise expressly authorized by Maitland-Smith or required by applicable law.
• This Warranty does not cover a product’s failure to comply with applicable laws, regulations, building codes, electrical codes, certifications, or manufacturing standards when the product has been misused, improperly installed, improperly assembled, altered, repaired, or modified after shipment from Maitland-Smith or after assembly approved by Maitland-Smith.
• Maitland-Smith is not responsible for labor, transportation, packing, delivery, removal, installation, storage, inspection, or other costs associated with a Warranty claim unless specifically authorized in writing by Maitland-Smith.

Some jurisdictions do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages. Accordingly, some of the limitations or exclusions stated above may not apply to you. This Warranty gives you specific legal rights, and you may also have other rights that vary by jurisdiction.

 

GOVERNING LAW

Except to the extent prohibited by applicable law, this Warranty shall be governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

CLAIM PROCEDURE

Warranty claims must be submitted in writing through the authorized Maitland-Smith dealer from whom the product was originally purchased.

To make a claim under this Warranty, the original purchaser must provide:

• A dated sales receipt or other acceptable proof of purchase
• The product style number and, when applicable, the fabric, leather, finish, or material description
• A written description of the alleged defect
• Clear photographs showing the product and the area of concern
• Any additional information reasonably requested by the authorized dealer or Maitland-Smith

The purchaser must retain the original sales receipt or proof of purchase throughout the applicable Warranty period. Failure to provide satisfactory proof of purchase may result in denial of the claim.

The authorized dealer will review the claim and, when appropriate, submit it to Maitland-Smith for evaluation. Maitland-Smith may require photographs, additional documentation, an inspection by an authorized representative, or the return of the product or component before determining whether the claim is covered.

No repair, replacement, return, disposal, or other corrective action may be undertaken without prior written authorization from Maitland-Smith. Unauthorized repairs, alterations, or disposal of the product may void this Warranty.
